By accessing and using our booking platform available at reservation.qallaingapnea.com (the "Services"), you agree to be bound by these terms of service. Please read them carefully before making a booking. If you do not accept these terms, please do not use our Services.

1. ACCEPTANCE OF TERMS

By accessing and using this booking service, you agree to be bound by these terms of service and all applicable laws and regulations. These terms constitute a legally binding agreement between you and Quentin AllainGuillaume (doing business as Qallaing Apnea & Sea).

If you do not agree to any of these terms, you are not authorized to use or access this service. By using our Services, you represent and warrant that you have the right, authority, and capacity to enter into this agreement and to abide by all terms set forth herein.

2. USE OF SERVICES

To use our Services, you must:

• Be at least 18 years of age or have the permission of a parent or legal guardian
• Provide accurate, complete, and up-to-date information when registering and booking
• Maintain the security of your account and accept responsibility for all activities that occur under your account
• Use the Services only for lawful purposes and in accordance with these Terms

3. BOOKINGS AND RESERVATIONS

When booking an activity through our Services:

• Booking Confirmation. You will receive a confirmation email after making a booking. This confirmation serves as your proof of booking and contains important details about your activity.
• Information Accuracy. You are responsible for the accuracy of all information provided when booking, including names, contact details, and number of participants.
• Availability. All bookings are subject to availability and confirmation. We reserve the right to cancel or modify a booking if the requested activity is not available.
• Booking Modifications. Booking modifications are subject to availability and may incur additional fees. Please contact us as soon as possible if you need to modify your booking.

4. CANCELLATION AND REFUND POLICY

Our cancellation policy is as follows:

• More than 48 hours before the activity: Free cancellation with full refund
• Between 24 and 48 hours before the activity: 50% refund of the amount paid
• Less than 24 hours before the activity: No refund
• No-show without prior cancellation: No refund and total forfeiture of the amount paid

To cancel a booking, you must contact us by email at qallaingapnea@gmail.com or by phone within the time frames indicated above. Cancellations are effective upon receipt of your cancellation notification. Refunds will be processed within 14 business days using the same payment method used for the booking.

5. PAYMENT TERMS

The following payment terms apply:

• Accepted Payment Methods. We accept payments by credit card (Visa, Mastercard), bank transfer, and cash (on-site only).
• Payment Timing. Payment may be required at the time of booking or on-site, depending on the type of activity and specific conditions. This will be clearly indicated during the booking process.
• Currency. All prices are shown in euros (EUR) including all applicable taxes (VAT included). Prices are subject to change without notice.
• Refunds. Refunds will be processed using the same payment method used for the original booking within 14 business days following cancellation approval.
• Payment Disputes. If you dispute a charge, please contact us immediately. Fraudulent chargebacks may result in legal action and additional fees.

6. USER RESPONSIBILITIES

As a user of our Services, you agree to:

• Provide accurate, complete, and up-to-date information for all bookings
• Arrive on time for your booked activity. Late arrival of more than 15 minutes may result in cancellation of your booking without refund
• Inform our team of any relevant medical conditions, physical limitations, disabilities, or allergies before participating in any activity
• Maintain respectful and appropriate behavior toward our staff, instructors, and other participants. We reserve the right to refuse service to anyone exhibiting inappropriate behavior
• Use any provided equipment correctly and with care. You will be held responsible for any damage caused by negligence or misuse

7. SAFETY, LIABILITY AND ASSUMPTION OF RISK

Please read this section carefully as it limits our liability:

• Acknowledgment of Risks. Freediving, diving, and water sports activities carry inherent risks, including but not limited to: drowning, barotrauma, physical injuries, decompression sickness, and other serious injuries. By participating, you acknowledge and voluntarily accept these risks.
• Safety Instructions. You must follow all safety instructions provided by our qualified and certified instructors. Failure to follow safety guidelines may result in serious injury or death and may void any insurance coverage.
• Equipment Use. Any equipment provided must be used only for its intended purpose and in accordance with instructions. Inspect all equipment before use and report any defects immediately.
• Medical Fitness. By participating, you represent that you are in good physical and mental health and have no medical conditions that could endanger yourself or others during the activity.
• Limitation of Liability. To the extent permitted by French law, our liability is limited to the amount paid for the relevant booking. We will not be liable for indirect, incidental, special, or consequential damages.

8. INTELLECTUAL PROPERTY

All content on our website and Services, including but not limited to text, graphics, logos, images, videos, photographs, and software, is the property of Quentin AllainGuillaume (Qallaing Apnea & Sea) or its content suppliers and is protected by French and international intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, publicly perform, republish, download, store, or transmit any material from our Services without prior written permission, except for your personal, non-commercial use.

9. PRIVACY POLICY

Your use of our Services is also governed by our Privacy Policy.

10. MODIFICATIONS TO SERVICES AND TERMS

We reserve the right to modify, suspend, or discontinue all or part of our Services at any time, with or without notice. We will not be liable to you or any third party for any modification, suspension, or discontinuation of the Services. In the event of adverse weather conditions or unforeseen circumstances, we reserve the right to postpone or cancel activities. In such cases, we will offer you rescheduling or a full refund.

We reserve the right to modify these Terms of Service at any time. Modifications take effect upon publication on this page with an updated "Last updated" date. Your continued use of the Services after publication of modifications constitutes your acceptance of these modifications. We encourage you to review these Terms periodically.

11. GOVERNING LAW AND DISPUTE RESOLUTION

Governing Law. These Terms of Service are governed by and construed in accordance with the laws of the French Republic. Any dispute relating to these Terms will be subject to the exclusive jurisdiction of the competent French courts of Rennes, France.

Dispute Resolution. In the event of a dispute arising from or relating to these Terms or our Services, we commit first to seeking an amicable solution through good faith negotiation. If an amicable settlement cannot be reached within 30 days, the dispute will be submitted to the competent courts. In accordance with European regulations on alternative consumer dispute resolution, you also have the right to use consumer mediation through an approved mediator.
